INITIATION OF AN INVESTIGATION INTO ALLEGED SUBSIDISATION AND DUMPING

On 12 November 2003, the Australian Customs Service (Customs) initiated
an investigation into the alleged subsidisation of olive oil exported to
Australia from Greece, Italy and Spain. Customs has also initiated an
investigation into the alleged dumping of olive oil from Italy. The
applications for countervailing and anti-dumping duty notices were
lodged by Inglewood Olive Processors Ltd on behalf of the Australian
industry.

The applications allege that the goods have been exported to Australia
at prices that include a countervailable subsidy, and in the case of
Italy, at prices that are less than their normal values. The
applications allege that the subsidy and dumping has caused material
injury to the Australian industry through price undercutting, price
depression, price suppression, negative profits and profitability,
negative return on investment and reduced ability to raise capital.

Customs will examine exports to Australia of olive oil during the period
1 October 2002 to 30 September 2003 to determine whether subsidisation
has occurred and, in the case of Italy, whether dumping has occurred.
Customs will examine details of the Australian market for the period 1
July 1999 to 30 September 2003 for injury analysis.

Australian Customs Dumping Notice No 2003/45 containing important
procedural details and Customs’ initiation report, detailing among other
things, a description of the subsidy, are available on the internet.
Both documents should be read in conjunction with this notice. Customs

with the formation of Barkworth Management Pty Ltd (now Barkworth
Holdings Pty Ltd).

In less than 7 years, the Barkworth Group has enjoyed spectacular growth

Australian Olive Industry". Perhaps the most visible achievement of the
Barkworth Group is its national penetration of the major supermarkets
with the Viva brand featuring the highly recognisable icon "Angelina",
owned by the Barkworth Group's 50% owned associate, Origin Olives
Australasia Pty Ltd ("OOAA").

Other major achievements include:

* the planting of more than 375,000 olive trees in three geographically
diverse locations * a planted area in excess of 15 square kilometres;

* the purchase of the Viva Olives operation, the largest processor of
olives in Australia, and major refurbishment of the Viva plant at
Loxton, South Australia, which included installation of a new oil
processing line; and

* the construction and commissioning of a new processing plant at
Inglewood in South West Queensland.

The Australian olive industry has paralleled the expansion of Barkworth
and continues to grow at a prodigious rate.

The Barkworth Group intends to maintain its leadership role by expansion
of its markets, its processing facilities, its farming activities and by
expansion of its investor base. Importantly, Barkworth is leading the
industry in its push for countervailing action against EU imports.
Success in this area will almost certainly see the Australian industry
assume ownership of its own domestic market for olive products and the
continuance of vigorous growth of the Australian olive industry.

as a Grower in Barkworth Olives Project No. 7 ("Project No. 7", or "the
Project") and as a joint venturer with Barkworth Land Corporation
Limited.

ok, let me see if i have this straight.....


first the boss of barkworths is caught lying about the so-
called "australian olive oil" by the ABC's Landline program late in
2002, whilst he was the sitting vice-president of the AOA(during
which time not only does the AOA not remove him from office nor
demand his resignation). not only that, then he has the front to use
the official AOA mailout to abuse his critics within the industry.

then in July this year, the Australian federal court charges him
(personally) and finds him guilty of fraudulent business activities(
by which time he has craftily re-invented himself thru a series of
corporate side-slipping and sell-outs).

now, he has the gall to claim to be "representing the australian olive
industry" (with the support of the AOA).

is it just me, or this countries olive industry just going from bad
to worse?

it's not only disgusting, it's downright embarassing.

maybe we shoud be giving some thought to dissolving the national
association(which is clearly become just a marketing arm for the
corporates) and let the state and regional associations grow and
prosper. at least they appear to have a modicum of self-respect and
corporate governance.
